Terms and Conditions of Purchase
1. GENERAL
1.1. The owner of the online store Shoppa24.ee (hereinafter referred to as the “Online Store”) is Stuffinstock OÜ (registration code 16366522), located at Tuule tee 7, Ilmandu, Harku Municipality, 76904 Estonia.
1.2. These Terms of Use govern the legal relationship between Shoppa24.ee (the Seller) and the person making a purchase (the Buyer) in connection with the sale and purchase of goods in the Online Store.
1.3. In addition to these terms and conditions, the legal relationships arising from the sale of products through the online store are governed by the laws of the Republic of Estonia.
1.4. The Seller may amend the terms of use of the online store and the prices of products and services. Notices of such changes will be posted on the online store website. The terms and prices in effect at the time the transaction takes place shall apply to the transaction.
1.5. The selection of products, prices, and discounts may differ from those offered at the Seller’s retail stores.
1.6. There is no warranty on the products! Purchases are covered by a 14-day return policy and a 2-year warranty.
1.7. Products are new, like-new, minimally used, or defective. The condition of the product is specified on the product page. By placing an order, you confirm that you are aware of the product’s condition.
1.8. The products do not come with instructions or an information sheet in Estonian, or do not come with any instructions or information sheet at all, as they are so-called "second-hand" goods.
1.9. Our product descriptions are based on information provided by the manufacturer.
2. PRICE
2.1. Information about the products is provided in the Online Store directly next to each product. Product prices include 22% VAT.
2.2. Product prices are listed next to the products in the Online Store. A delivery fee will be added to the price unless otherwise specified at the time of payment. The delivery fee depends on the Buyer’s location and the delivery method. The delivery fee is displayed to the Buyer when placing the order.
2.3. The Online Store has the right to rescind the sale and demand that the Buyer return the goods if, due to an error, the price of the goods listed in the Online Store is significantly lower than the market price of the goods.
3. PLACING AN ORDER
3.1. To order merchandise, add the desired products to your shopping cart. To place an order, fill in the required fields and select the appropriate shipping method.
3.2. You can change the products and quantities in your shopping cart and remove products from the shopping cart until you have paid for the products.
3.3. When placing an order, the final price is displayed on the screen, and payment can be made via a bank link or another payment method.
3.4. The Agreement shall take effect upon receipt of the amount due in the Online Store’s bank account.
3.5. The Seller will send a confirmation of the order to the Buyer’s email address. If you do not find the email in your inbox, please check to see if it has been accidentally filtered into your spam folder.
3.6. The Seller has the right to withdraw from the contract if the ordered goods cannot be delivered due to the goods being out of stock or for any other reason. The Seller shall notify the Buyer of this as soon as possible and shall refund the full amount paid for the ordered goods (including shipping costs) without delay, but no later than 14 days after sending the notification.
4. PAYMENT
4.1. The Buyer shall pay 100% of the purchase price for purchases made in the online store in advance.
4.2. Orders can be paid for via Estonian bank links or by invoice.
4.3. Payment is processed outside the online store in a secure environment. The Seller does not have access to the Buyer’s bank or credit card information.
5. DELIVERY
5.1. The online store ships products to Estonia, Latvia, Lithuania, and Finland.
5.2. Products will be delivered using the method selected by the Buyer in the Online Store.
5.3. The Buyer is responsible for shipping costs, and the corresponding pricing information is displayed next to the shipping method.
5.4. The Seller ships orders on business days, but no later than four business days after the order is confirmed. In exceptional cases, the Seller reserves the right to deliver the goods within up to 30 calendar days. This includes special orders.
6. RIGHT OF WITHDRAWAL, RETURNS, AND EXCHANGES
6.1. The Buyer has the right to withdraw from the transaction within 14 calendar days by submitting to the Seller a written notice of withdrawal from the purchase of the goods, which must include the following information:
- First Name and Last Name
- Contact Phone Number
- Email address
- Address
- Bank Account Information
- Order Date
- Date of receipt of the item
- Description of the item being returned
- Product serial number
- Purchase Invoice Number for the Goods
- Reason for Return
6.2. A notice of withdrawal from the purchase of goods must be sent to the email address info@shoppa24.ee or to the address Tuule tee 7, Ilmandu, Harku Municipality, 76904, no later than 14 calendar days after receipt of the goods. The Seller will confirm receipt of the notice of withdrawal by sending a notification to the Buyer.
6.3. The returned product must include all purchase documentation. Labels attached to the merchandise and any items installed to protect the condition of the merchandise must remain in place when the merchandise is returned.
6.4. To exercise the 14-day right of return, the ordered goods must not be used in any way other than is necessary to ascertain the nature, characteristics, and functioning of the goods. If the goods have been used for any other purpose, the Seller has the right to reduce the refund amount in proportion to the decrease in the value of the goods or to refuse to reimburse the cost of the goods.
6.5. The return policy applies to standard-size products. Custom orders and products customized to meet specific requests are not eligible for return.
6.6. The buyer may exchange the ordered product within 14 calendar days of receiving it if the size of the ordered product is unsuitable.
6.7. If a product returned to the Seller cannot be exchanged due to the unavailability of the size requested by the Buyer, the Seller will contact the Buyer to propose a solution.
6.8. Starting from the date on which the notice of withdrawal from the purchase of the goods is submitted, the Buyer is required to return the product subject to return within 14 calendar days.
6.9. The Seller assumes no liability for the product until it has been received. Returning and/or exchanging the product is free of charge, except for return shipping costs, which are borne by the Buyer. If a defective product has been delivered to the Buyer, the Seller shall bear the costs associated with the return.
6.10. Upon receipt of the returned goods, the Seller shall refund the Buyer immediately, but no later than 14 days after receiving the notice of withdrawal, the cost of the product (shipping costs are not refundable, unless the Buyer was delivered a defective or incorrect product).
6.11. The Seller reserves the right to delay refunds until it has received the item that is the subject of the contract.
6.12. The Seller has the right to rescind the sale and demand that the Buyer return the goods if, due to an error, the price of the goods listed in the Online Store is significantly lower than the market price of the goods.
6.13. These products come with no warranty and no 2-year right to file a claim, as they are second-hand goods. Purchases are covered only by a 14-day right to return.
7. RIGHT TO FILE A CLAIM
7.1. The Seller is liable to the Buyer for any nonconformity with the terms of the contract or defect in the goods sold to the Buyer that existed at the time of delivery, and the Buyer must notify the Seller thereof within 14 days. The Seller is not liable for defects that arise after the goods have been delivered to the Buyer.
7.2. Upon discovering that a product does not conform to the requirements or has defects, the Buyer is obligated to notify the Seller immediately, but no later than 14 days after becoming aware of the nonconformity, by sending the relevant information via email to info@shoppa24.ee or in writing to Tuule tee 7, Ilmandu, Harku vald, 76904 Estonia.
7.3. In the event that a product does not meet the requirements or is defective, the Buyer has the right to request that the product be repaired or replaced with a product that meets the requirements and is free of defects, or to return the product at the Seller’s expense.
7.4. The buyer has the right to demand a reduction in the purchase price of the product or termination of the contract, and to request a refund of the amounts paid for the product, if:
- The seller is unable to repair or replace the product, or
- the repair or replacement of the product fails, or
- The seller has not remedied the defect in the product within a reasonable time
7.5. If a non-conforming product is returned, the Buyer will be reimbursed for the amount paid for the product, including shipping costs, to the bank account specified by the Buyer within 14 days at the latest.
7.6. The Seller shall not reimburse the Buyer for any expenses incurred due to the product’s nonconformity with requirements or defects, nor shall the Seller be liable for such expenses, if:
- The value of the product has decreased/the product has been damaged due to the buyer's fault;
- The defects have arisen as a result of the product being used for purposes other than those for which it was intended;
- The value of the product has decreased due to normal wear and tear resulting from regular use;
- There is no copy of the document proving the purchase.
7.7. In the event of a dispute between the Buyer and the Seller regarding product defects, the Buyer has the right to file a complaint with the Seller. The Seller will respond to the Buyer’s complaint within 14 calendar days. Please send complaints to the email address info@shoppa24.ee.
7.8. If the Buyer and the Seller are unable to reach an agreement regarding a dispute, the Buyer has the right to seek out-of-court resolution of the dispute through the Consumer Disputes Committee operating under the Consumer Protection Board in Estonia. 7.9. If the parties disagree with the Commission’s decision, they have the right to file a claim with the county court in the Buyer’s place of residence.
8. PROCESSING OF PERSONAL DATA
8.1. The controller of personal data is Stuffinstock OÜ (registration number 16366522), located at Tuule tee 7, Ilmandu, Harku Municipality, 76904, Estonia.
8.2. The processing of personal data is carried out in accordance with Estonian and European Union law.
8.3. The data controller collects the following personal data: name, phone number, address, email address, and bank details. The data is used solely for processing the order and shipping the goods to the Buyer. The Seller will disclose personal data to companies providing shipping services for the purpose of delivering the goods.
8.4. Personal data provided to the data controller is protected and treated as confidential information. Data transmission between the customer and the banks is encrypted. The data controller will not disclose any data that has come to its attention to third parties.
8.5. The controller of personal data may send newsletters, including satisfaction surveys and offers, to the Buyer’s email address solely for marketing purposes on behalf of Stuffinstock OÜ.
8.6. The buyer has the right to file a complaint with the Data Protection Inspectorate or a court if they believe that their rights have been violated in connection with the processing of personal data.
